No Forensic evidence links Tracy to the killings. Prosecution and conviction based entirely on speculation

Independent forensic pathologist concluded that alleged murder weapons could NOT have inflicted wounds on the victims


No DNA from either victim was found on the alleged murder weapons. Experts stated that DNA would have been found no matter how well weapons were cleaned


The prosecution claimed Tracy acted alone. Violent crime experts state that there were at least two perpetrators


Crime expert concluded that this type of crime was likely done by someone with a history of similar violent crimes. Tracy does not have a history of violent crimes


Tracy had been visiting with the victims at an apartment the evening before the crimes. They were his ride back home to the reservation. An argument broke out on the phone between one of the victims and the woman who lived at the apartment (who was not present). This woman. was upset there were unauthorized guests at her apartment and threatened to "send some people over to kick everyone out"


Fearing police due to an active warrant for burglary, Tracy left the apartment to go visit his girlfriend


The upstairs neighbor stated he saw a man leaving the scene minutes before the 911 call came in. He described a person shorter than 5'9" and heavy set. He stated this person was shorter and heavier than the apartment renter's boyfriend. Tracy is 6'2" and not heavy set.

DID match the brother of the apartment owner's boyfriend who was on pre-trial release for attacking his girlfriend in a similar manner to the female victim


The brothers lied about their whereabouts the night of the murders, claiming they were 50 miles away


Phone records show there were 35 contacts from the brother's phone made in the city where the crimes. occurred on the night of the murders.

The contacts were between them and the apartment's owner, who was 50 miles away


One hour after the 911 call came in, federal probation received a call from the brother who was on pre-trial release (placed in the town of the murders) stating that he could not meet with his probation officer because he needed to meet with his defense lawyer 250 miles away
